Equipment Warranty and Performance Guarantee
Equipment Warranty
Aquatic Treatment Systems Inc. (ATS) warrants that all equipment and components
supplied by ATS under the System Agreement shall be free from defects for a
period of one (1) year from installation. This warranty does not apply to
consumable filters and media. The Equipment Warranty shall not apply to
equipment or components of the System that have been repaired or altered by any
party not authorized by ATS, or to equipment or materials which have been
subjected to negligence, accident or damage, due to improper operation or
maintenance, or due to other than normal use. Liability is limited to the repair
or replacement of any defective item which will be at ATS' discretion.
Performance Guarantee
ATS guarantees that the System will maintain arsenic levels in the treated water
to the lower of a) the Owner's State Maximum allowable Contaminant Level or b)
the United States Environmental Protection Agency Maximum Contaminant Level of
10 parts per billion (ppb) or 0.010 mg/L. If the System does not perform to this level, and
provided that it has not been altered, repaired or damaged by anyone not
authorized by ATS or otherwise improperly operated, used, or maintained, and
provided that media change-outs are made when required based upon the results of
routine water analysis, and further provided that the composition of the well
water does not change substantially from the well water samples that were the
basis for design, ATS will, at its option, either modify the System to meet this
Performance Guarantee, or remove the System and provide a complete refund of the
purchase price. The above described Performance Guarantee is valid and
enforceable only so long as the Service Contract described below is in force.
Service Contract
The Service Contract provides labor and laboratory analysis for the following
testing and servicing of the System. Periodically, water samples will be taken
and tested by a certified independent laboratory. Test results will be made
available to Owner upon distribution to ATS. The Service and Maintenance of the
System will be provided as needed, including the replacement and disposal of
media. Service Contract fees and other details are outlined in the Owner's
Proposal/Agreement.
